CONTEST RULES
By entering this Contest, entrants agree to abide by these Official Rules. The decisions of the independent contest organization with respect to all aspects of the contest are final.
NO PURCHASE NECESSARY: The Ultimate Breyers® Moment Contest (the “Contest”) is sponsored by Unilever Canada Inc. (the “Sponsor”). The Contest begins at 10:00:01 AM (ET) on July 5, 2009 and ends at 5:00:00 PM (ET) on August 31, 2009 (the “Contest Period”). The Sponsor is responsible for the operation of the Contest and is the sole supplier of all prizing.
- ELIGIBILITY: To enter and to be eligible to win, a person must be a resident of Canada at time of entry, who has reached the age of majority in the jurisdiction in which he/she resides and who is not an employee of the Sponsor, its affiliated companies or agents, their respective advertising or promotional agencies, the independent contest organization or a member of any such employee’s immediate family (whether related to the employee or not). In these Official Rules, “immediate family” includes mother, father, brothers, sisters, sons, daughters, partner or spouse. You must have your friend or family member’s permission to include them in your entry into the Contest.
- HOW TO CREATE A BREYERS® MOMENT AND ENTER THE CONTEST: To create an Ultimate Breyers® Moment, visit www.breyers.ca. Next, click on the “Create a Breyers® Moment” icon and enter your full name, a friend or family member’s full name and select from the drop down box the reasons why you should have a Breyers® Moment together. Next, click the “See Your Moment” icon to reveal the Breyers® Moment you created. Enter your valid email address and your friend’s/family’s valid email address to send them your Breyers® Moment. Upon doing so, click the “enter” icon and complete the entry form with your complete mailing address (including postal code), daytime telephone number (including area code), date of birth, answer without assistance of any kind, mechanical or otherwise, the mathematical skill-testing question, indicate whether you would like to receive information regarding upcoming promotions from the Sponsor and confirm compliance with the Official Contest Rules. Upon doing so, click the “submit” icon and you will be entered automatically once into the Contest. Entries must be received by 5:00:00 PM (ET) August 31, 2009 (the “Contest Closing Date”). Limit one (1) entry per person per email per day to a maximum of ten (10) entries total will be accepted during the Contest Period. Limit of one (1) Prize per person.
- GRAND PRIZES: There will be three (3) Grand Prizes available to be won consisting of the following:
- Grand Prize #1 Romantic Night in at the Movies - consists of one (1) 42” flat screen TV as selected by the Sponsor, one (1) Blu-ray DVD player as selected by the Sponsor, one milkshake blender as selected by the Sponsor, a supply of 3 Breyers® Double Churn Ice-Cream as selected by the sponsor and one (1) $500.00 (CDN) Blockbuster Gift Card.
- Grand Prize #2 Ultimate Backyard Barbeque - consists of one (1) BBQ as selected by the Sponsor, one electric cooler as selected by the Sponsor, a supply of 3 Breyers® Double Churn Ice-Cream as selected by the Sponsor, and one (1) $500 Metro Gift Card.
- Grand Prize #3 Gourmet Evening with a Private Chef - consists of a five (5) course meal prepared, cooked and served by a chef as selected by the Sponsor for two (2) people at the winner’s home at a mutually convenient time. Included also in the Grand Prize is a proposed menu by the selected chef and all ingredients required for the menu. Dessert will include Breyers® Double Churn Ice-Cream as selected by the Sponsor. Blackout periods may apply including all 2009 and 2010 Canadian statutory holidays. Grand Prize #3 must be used by December 31, 2010 or the Grand Prize will be forfeited.
The approximate retail value of each Grand Prize is $3,000.00 (CDN). If desired, a Grand Prize winner will have the option of taking $2,500.00 (CDN) cash in lieu of the applicable Grand Prize described above, which will be issued in the form of a cheque made payable to the confirmed winner as his/her name appears on the Release Form (see rule 7). Gift Cards have no cash surrender value and no expiry date. Any unused portion of a Gift Card will remain on the Gift Card until the total value of the Gift Card is used (for example: if a Gift Card is for $500.00 (CDN) and $100.00 (CDN) is used for the first purchase, $400.00 (CDN) will remain on the Gift Card and so forth until the total value of the Gift Card is used). Grand Prizes must be accepted as awarded without substitution and are not transferable or for resale. Grand Prizes must be accepted as awarded without substitution and are not transferable. The Sponsor reserves the right, in the event that a Grand Prize or any component of a Grand Prize cannot be awarded as described for any reason, to substitute another prize or component of a prize of equal or greater value, without liability.
- SECONDARY PRIZES: There will be four hundred (400) Secondary Prizes available to be won, each consisting of one (1) 1.89L tub of Breyers® Double Churn Ice-Cream issued in the form of a coupon which may be redeemed and a participating retail store across Canada. The approximate retail value of each Secondary Prize is $9.00 (CDN). Secondary Prizes must be accepted as awarded. Secondary Prizes may not be transferred and are not convertible to cash. The Sponsor reserves the right to substitute a Secondary Prize in whole or in part in the event that a Secondary Prize is unavailable
- GRAND PRIZE DRAW: A Random Draw will be held on September 10, 2009 at 10:00 AM (ET), (the “Grand Prize Draw Date”) in Mississauga, Ontario from among all eligible entries received by the Contest Closing Date. The first (1st) selected entrant will be eligible for Grand Prize #1, the second (2nd) selected entrant will be eligible for Grand Prize #2 and the third (3rd) selected entrant will be eligible for Grand Prize #3. Odds of being selected for a Grand Prize depend on the total number of eligible entries received by the Contest Closing Date. The Grand Prize selected entrants will be contacted by mail or telephone within ten (10) business day of the Grand Prize Draw Date. If a Grand Prize selected entrant cannot be reached within ten (10) business days of the draw date, the selected entrant will be disqualified and another entrant will be randomly selected until such time as contact is made by mail or telephone with a selected entrant or there are no more eligible entries, whichever comes first. The Sponsor will not be responsible for failed attempts to contact a Grand Prize selected entrant.
- SECONDARY PRIZE DRAW: A Random Draw will be held on September 10, 2009 at 11:00 AM (ET), (the “Secondary Prize Draw Date”) in Mississauga, Ontario from among all eligible entries received by the Contest Closing Date that has not been selected as eligible to win a Grand Prize. Odds of being selected for a Secondary Prize depend on the total number of eligible entries received by the Contest Closing Date.
- To be declared a Grand Prize winner, each selected entrant’s answer to the mathematical skill-testing question must be verified and deemed correct. If a selected entrant’s answer to the mathematical skill-testing question is incorrect, he/she will be disqualified and another entrant will be randomly selected. Each selected entrant will also be required to sign a Declaration and Release Form (the “Release Form”) confirming compliance with the official rules, acceptance of a Prize as awarded, without substitution, and releasing the Sponsor, its affiliated and related companies, advertising and promotional agencies, the independent contest organization and their respective shareholders, directors, officers, employees, agents, representatives, successors and assigns (collectively, the “Released Parties”) from any liability in connection with a Prize or the Contest. The Release Form must be returned within the time period specified on the Release Form or the Prize will be forfeited. Prizes will be delivered by courier to the winners by the Sponsor, to the address provided on the Release Form of each winner, within thirty (30) days of being declared a Grand Prize winner.
- To be declared a Secondary Prize winner, each selected entrant’s answer to the mathematical skill-testing question must be verified and deemed correct. If a selected entrant’s answer to the mathematical skill-testing question is incorrect, he/she will be disqualified and another entrant will be randomly selected. The Secondary Prize will be delivered to each Secondary Prize winner by the Independent Contest Organization within thirty (30) days of being declared a Secondary Prize winner to the address supplied at the time of entry.
- The Sponsor accepts no responsibility for loss, damage or claims caused by or resulting from the Contest or any Prize. By entering, each winner consents to the use of his/her name, address (city and province) and/or photographs, without further remuneration, in connection with any publicity carried out by or on behalf of the Sponsor with respect to this contest.
- The Sponsor and the independent contest organization will not be responsible for late, lost, illegible, incomplete or destroyed entries; all such entries are void. The Sponsor and the independent contest organization will not be liable for any failure of the Contest Website, do not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer lines or networks, computer equipment, software or any combination thereof. Entry material/data that have been tampered with or altered are void. The use of an invalid email address will disqualify the entry. Users spamming the same email address will disqualify the entry. In the event of a dispute, online entries will be deemed to have been submitted by the authorized account holder of the email address submitted at the time of entry. “Authorized account holder” is defined as the person who is assigned an email address by an internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. If the identity of an entrant is disputed, the authorized account holder associated with the email account at the time of entry will be deemed to be the entrant. A selected entrant may be required to provide proof that he/she is the authorized account holder of the email address associated with the selected entry name. The sole determinant of the time for the purposes of a valid online entry in this Contest will be the contest server machine(s). In the event it is determined that an entrant has entered in a fashion not sanctioned by these rules and/or has submitted more than the number of entries permitted by these rules, the entrant will be disqualified and all of the entries submitted by the entrant will be disqualified.
- The Sponsor reserves the right, with the consent of the Régie des alcools, des courses et des jeux (the “Régie”) in the Province of Québec, to terminate or amend this Contest at any time and in any way, without prior notice. Without limiting the foregoing, if, for any reason, the Contest is not capable of running as originally planned, such as tampering, the Sponsor reserves the right, with the consent of the Régie, to cancel the Contest and conduct the draw from all previously received eligible entries received by the Contest Closing Date. The Sponsor and the independent contest organization shall not be held responsible for any problems, errors or negligence that may arise or occur in connection with the Contest, including, but not limited to, any damage to an entrant’s computer equipment, system, software or any combination thereof, as a result of the entrant’s participation in this Contest.
- All entries become the permanent property of the Sponsor and none will be returned. No correspondence will be entered into except with the potential winners. This Contest is subject to all applicable federal, provincial and municipal laws.
- For Québec residents only: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
- IThe Sponsor respects your right to privacy. Personal information collected from entrants will only be used by the Sponsor to administer the Contest and fulfill any prize requirements and, only if consent is given at the time of entry, to provide the entrants with information regarding upcoming promotions and/or events from the Sponsor.
